A guardianship order allows someone to make ongoing decisions on behalf of an adult with incapacity.

In the event of lack of mental capacity in a person aged 16 or over, and in the absence of a Power of Attorney, it may be that a Guardianship or Intervention Order has to be sought from the Court to allow family members to look after their affairs.

The process for this is governed by the Adults with Incapacity (Scotland) Act 2000 and we can guide you through the process in collaboration with the Local Authority and other organisations involved.
