Conveyancing is the legal process of transferring ownership of property and we aim to make it as stress-free as possible.
If you are buying, we can advise on prices and market trends, review the Home Report and note interest on your behalf before submitting a formal written offer. We will check the title deeds and if any alterations carried out to the property require appropriate local authority consents. If you are taking out a mortgage we deal directly with your lender to ensure the loan funds are available in time for completion. We will also arrange the handing over of the keys in exchange for the price.
If you are selling, we can advise on negotiating the price and entry date. We will discuss the accepted offer with you before endeavoring to conclude the missives (the contract) as quickly as possible. If you have a mortgage over the property we attend to repaying the balance due at completion, together with your estate agents’ invoice.
When your mortgage is paid off (redeemed) the standard security should be discharged, or removed, from your title. We will prepare the necessary discharge document, have it signed by your lender and then register the discharge in the Land Register of Scotland. You can let us know if you wish us to keep your title in our safe or keep them yourself.
We will request your title deeds from your existing lender and obtain a statement from your current lender as to how much is to be repaid. We check the amount with you and when we receive our loan instructions from your new lender, request the loan funds. Once we have checked the title and the searches, and you have signed the new standard security, we settle your old mortgage at the same time as drawing down the new loan to be secured on your property. We will also account to you for any funds due to or from you and take care of the registration of the documents in the Land Register of Scotland.
